Introduction of Commissioners and staff. 2. Public Hearing and Action: Continued consideration of a request for approval of modifications to a previously approved development plan for a portion of the Amberley Woods Development. The requested approvals include: 1) amendments to the Special Use Permit; 2) approval of alternate site, landscape and tree removal plans; 3) approval of amendments to the plat of subdivision to consolidate lots, modify established setbacks and eliminate drainage easements; 4) approval of two drive through facilities and a bank as special uses; and 5) approval of variances from the City Code as needed. Given the lengthy testimony heard by the Commission to date on this petition, the Commission requests that testimony be limited to new information and comments on revised materials submitted by the petitioner. The retail center is proposed on an approximately 8.5 acre portion of the Amberley Woods development. The site is located on the southeast corner of Route 60 and Saunders Road. The plan proposes a commercial development comprised of retail, restaurant and limited service businesses. A Whole Foods Market is proposed as the anchor tenant. Public Hearing and Action: Continued consideration of a Code Amendment relating to Medical Cannabis Dispensaries and Cultivation Centers in response to recent State legislation. The proposed amendment would establish a Special Use Process and criteria for evaluating petitions, if any are received, for these types of facilities. 4. Public Testimony on non-agenda items. 5. Public Testimony - not to exceed 5 minutes per speaker. 7. Opportunity for cross examination. 8. Staff response to public testimony - not to exceed 5 minutes. 9. Petitioner rebuttal - not to exceed 10 minutes. 10. Final questions from Commission to Petitioner or Staff. 11. Commission discussion and comment 12.
