MINUTES
I. Call to Order: The Chairman called the Board of Fire and Police Commissioners to order at 6:08
p.m.
II. Roll Call:
Present: Chairman Davis, Commissioner Kernahan
Absent: Commissioner Nikitas
Also Present: Board Secretary Kalmar, Attorney for the Board Gehrt
III. Executive Session:
Motion by Kernahan, second by Davis, to adjourn into executive session pursuant to Section 5
ILCS 120/2(c)(1) and 2(c)(4) for the purpose of discussing personnel matters. Motion carried.
IV. Roll Call on return to Regular Session:
Present: Chairman Davis, Commissioner Kernahan
Absent: Commissioner Nikitas
V. Action on Personnel Matters:
1. Admission of Charges and Acceptance of Disposition for Officer Wendy Dumont
Motion by Kernahan, second by Davis, to accept an Admission of Charges and Acceptance of
Disposition that was negotiated between Chief Walldorf and Officer Wendy Dumont.
Motion carried.
2. Charges Filed Seeking the Termination of Officer Dominick Bellino
Chief Walldorf and Officer Bellino were both present and represented by Counsel – Brian
Smith and Ray Garza, respectively. The attorneys agreed to accept electronic service of any
documents served, either by the Commission or one another, and the Commission agreed to
accept electronic service of documents sent to the Board’s attorney, Mr. Gehrt.
Mr. Smith stated that they seek to arrange a hearing date and put the matter before the
Board. Mr. Garza stated that they do not waive any rights, including matters of jurisdiction,
timeliness, or legal arguments to grant termination for cause.
Mr. Garza has indicated on behalf of the Respondent that he intends to file a pre-hearing
motion. The Commission will receive and consider that motion. The parties have agreed to
the following briefing schedule:
a. Respondent’s motion to be filed on or before May 21.
b. The Chief’s response to be filed on or before June 14.
c. The Respondent’s reply, if any, to be filed on or before June 29.
d. The Commissioners will convene a hearing on July 17 to rule on the issues presented in
the Respondent’s pre-hearing motion. If necessary, the parties will present evidence
regarding the merits of the charges.
e. The Commissioners authorized Board Attorney Benjamin Gehrt to sign subpoenas and
similar discovery documents on behalf of the Commission.
VI. Adjournment: Motion by Davis, second by Kernahan, to adjourn at 7:15 p.m. Motion carried.
