Approval of a Resolution Allowing the City to Perform Work on State Rights-of–Way To perform scheduled or emergency work on a State right-of-way, the City must first obtain a permit from IDOT. A surety bond is required with each permit application to ensure all work is completed in accordance with State standards and that the right-of-way is properly restored. In lieu of a surety bond, the City may adopt a resolution providing the same guarantees. To minimize additional paperwork, such resolutions must be enacted for a period of two years. A copy of the draft resolution is attached beginning on page Recommended Action: Approval of the Consent Agenda as presented. ORDINANCES OLD BUSINESS NEW BUSINESS 1. Consideration of a Report and Recommendation from the Zoning 8:35 p.m. Board of Appeals for a Variance from the Lot-In-Depth Requirements for Property Located at 430 N. Washington Road. Presented by Assistant Planner Megan O’Neill (615-4587) On February 26, 2007, the Zoning Board of Appeals held a public hearing to consider a request for a variance from the lot-in-depth setback requirements to allow construction of an addition to the west of the existing residence at 430 N. Washington Road. The Carris residence is accessed by a private drive off of Washington Road shared by three other properties. The southern property line of 430 N Washington runs through the paved access easement of this private drive. The existing house is setback just under 22.5 feet from the south property line, but is sited immediately adjacent to the paved driveway. The home at 430 N Washington is not visible from Washington Road and there are no significant trees impacted with this request. As a lot-in-depth property in the R3 district, the required setback from all property lines and from the access easement is 40 feet. The house is currently non-conforming and encroaches into the south and east setback areas. The owner, Mr. Carris, is requesting a variance to construct a one and a half story addition extending west approximately 45 feet from the existing house. At the furthest point of encroachment the proposed addition will be setback 12’4” from the south property line. The overall height of the addition is lower than the existing house and is compatible in form and design. The addition will be visible from the private drive but the increased mass is mitigated by the design of the addition. Because this property is located in the historic district, this request was also reviewed and approved by the Historic Preservation Commission. Some Commissioners and neighbors raised concerns about the scale and location of the addition. The petitioner worked with a subcommittee of the Historic Preservation Commission to modify the plans. The modified plans were unanimously approved by both the Historic Preservation Commission and the Zoning Board of Appeals as submitted. The ordinance, with site plan, elevations and findings is included in the Council packet beginning on page ___. Recommended Action: Waive first reading and grant final approval of a lot in depth setback variance on the south side of the lot to allow an addition as shown in Exhibit B. 2. Consideration of a Report and Recommendation from the Zoning 8:35 p.m. Board of Appeals for a Variance from the Lot-In-Depth Requirements for Property Located at 211 Maple Court. (First Reading, and if desired by City Council, Final Approval) Presented by Assistant Planner Megan O’Neill (615-4587) On February 26, 2007, the Zoning Board of Appeals held a public hearing to consider a request for a variance from the lot-in-depth setback requirements for property located at 211 Maple Court. The petitioners, Steve and Anne Skinner, are requesting approval of the zoning variance to allow construction of a second story addition. This property is in the R-4 zoning district and is a lot-in-depth which requires a 50 foot setback from all property lines and from the access easement. The existing residence is non-conforming with respect to the lot-in-depth setback requirements and is sited to the northwest of the lot. The structure is located a significant distance from the ravine that runs through the southern edge of the property. The proposed addition will not encroach beyond the furthest point of encroachment of the existing residence and the increased mass of the second story is mitigated by existing mature vegetation. Because this property is located in the historic district, this request was also reviewed and unanimously approved by the Historic Preservation Commission on February 28, 2007. Two letters of support for this project were submitted to the Zoning Board of Appeals and the Historic Preservation Commission and there were no objections to the request heard at the respective hearings. The Zoning Board of Appeals voted unanimously to recommend approval of the variance as submitted. The ordinance, with site plan and findings is included in the Council packet beginning on page ___. Recommended Action: Waive first reading and grant final approval of a lot in depth setback variance to allow construction of a second story addition and alterations as shown in Exhibit B. 3. Consideration of a Report and Recommendation from the Zoning Board 8:50 p.m. of Appeals for a Variance from the Front Yard Setback Requirement for Property Located at 292 Granby Road. (First Reading, and if desired by City Council, Final Approval) Presented by Senior Planner Peter Coutant (604-5655) On February 26, 2007, the Zoning Board of Appeals held a public hearing to consider a request for a variance from the front yard setback requirement to allow construction of a second floor addition to the residence at 292 Granby Road. The existing residence is legal nonconforming and encroaches into the 40 foot front yard setback. The surrounding area is an established neighborhood with homes constructed in the early 1900s, most of which are legal nonconforming and predate the current setback requirements. The property is zoned GR-2. The required front yard setback is 40 feet. The existing residence is setback 21.87 feet from the front property line. The setback of the house from the street is generally consistent with the prevailing setback pattern of other houses on this block. The proposed second floor addition is located over the main section of the house. The addition does not encroach any further into the setback area than the existing structure. No other additions to the house are proposed. The Zoning Board of Appeals voted unanimously to recommend approval of the variance as submitted. The architectural design and configuration of the proposed addition was also reviewed and approved by the Building Review Board. There were no objections to this request from surrounding property owners. The ordinance, with site plan and findings is included in the Council packet beginning on page ___. Recommended Action: Waive first reading and grant final approval of a variance from the front yard setback requirement to allow the proposed second floor addition to be setback 21 feet from the front property line.
