Consideration of a Request for Funding to Install and Connect Sanitary and Storm Sewers, and Bury an Overhead Electrical Cable at Elawa Farm On October 4, 2007, Mayor Rummel convened a meeting with the City's Architect and Project Manager, John Krasnodebski from Lake Forest Landmark Development,  Ashley Maentz and representatives from the Elawa Foundation, and Marcus Peccia, Assistant City Manager, to discuss the current status of the Phase II Elawa Farm Renovation Project, and specifically items that require additional funding.   Mayor Rummel reviewed quotations that John from Landmark had received for the additional items, which included for example a new roof, masonry, and foundation repair, sanitary and storm sewer installation and connection, and burial of an overhead electric service cable, totaling to $456,625.   All parties agreed that the additional work is required.  Mayor Rummel stated that he would ask the City Council to consider funding two items: the burial of the overhead electric service cable, and the installation and connection of sanitary and storm sewers since Elawa Farm is owned by the City, and given the nature of the items, it should be the City's responsibility.   Using the lowest quotation received by Landmark, John reported that the total cost for each item that the Mayor is requesting that the City Council consider funding is as follows:   - Sanitary and Storm Sewer Installation and Connection at $66,700 from DeMuth - Burial of Overhead Electric Service Cable at $5,175 from Falcon Electric   Recommended Action: Authorize the expenditure of $71,875 for Phase II Elawa Farm Renovation work to Lake Forest Landmark Development. Finance Committee Report 1. Consideration of the FY07 Treasurer’s Report PRESENTED BY FINANCE COMMITTEE CHAIRMAN ALD. GRUMHAUS Pursuant to Illinois State Statute, a Treasurer’s Report must be filed with the City Clerk, the County Clerk, and published within a Lake Forest newspaper within six months after the end of each fiscal year. The report will be published in the October 25, 2007 edition of the Lake Forester. A copy is attached for your consideration beginning on page 9. Recommended Action: Acknowledge receipt of the FY07 Treasurer’s Report. (Staff Contact person: Kathy Reinertsen 615-4222) OPPORTUNITY FOR PUBLIC TO ADDRESS THE CITY COUNCIL ON NON-AGENDA ITEMS CONSENT AGENDA 7:55 p.m. 1. Consideration of an Ordinance Amending Chapter 35 of the City Code regarding Purchasing (First Reading and Final Approval) This item was discussed at the September 17, 2007 Finance Committee meeting. The recommendation is to waive first reading of the ordinance, and grant final approval. A copy of the ordinance is attached beginning on page 18. Recommended Action: Approval of the Consent Agenda as presented. ORDINANCES 1. Consideration of a Report and Recommendation from the Historic 8:00 p.m. Preservation Commission to Designate 1275 N. Waukegan Road as a Local Historic Landmark (First Reading and, if desired by the City Council, Final Approval) PRESENTED BY SENIOR PLANNER PETER COUTANT (847-604-5655) On September 26, 2007, the Historic Preservation Commission held a public hearing to consider the Local Landmark nomination of the residence at 1275 N. Waukegan Road. Nominations must meet at least one of the ten criteria from the Historic Preservation Ordinance to qualify as a Local Landmark. The nomination report provided by the petitioner accurately and completely discusses the historic and architectural context and significance for the development and evolution of the residence, beginning with its construction in 1929. Based on this information, the residence qualifies for designation under criteria 1 and 2 of the ordinance. Criteria 1: Its exemplification of an architectural type, style, or design distinguished by innovation, rarity, uniqueness, or overall quality of design, detail, materials, or craftsmanship. The nomination discusses the significance of the residence as an architecturally significant example of the French Eclectic style, characterized by irregularity and variety of shape and materials. Criteria 2: Its identification as the work of an architect, designer, engineer, or builder whose individual work is significant in the history or development of the District, the City of Lake Forest, the State of Illinois, or the United States. The residence was designed by architect Ralph Varney. Varney is best known for the homes and buildings he designed in the 1920s throughout the North Shore. In Lake Forest, Varney also designed the Clifford Leonard property, Meadowood Farm, located at 550-575 Hathaway Circle. This complex of buildings was constructed as a gentleman’s farm in 1923 and designed in the French Norman architectural style. These buildings were designated as both a Local Historic District and a National Register Historic District in 2000. The Historic Preservation Commission voted unanimously to recommend approval of 1275 N. Waukegan Road as a Local Landmark. There were no objections from surrounding property owners to this request. The ordinance amending the Historic Preservation Ordinance accordingly and the nominating report are included in the packet beginning on page 22. Recommendation: Waive first reading and grant final approval of an amendment to Chapter 51, Historic Preservation, of the Lake Forest City Code designating 1275 North Waukegan Road as a Local Landmark. 2. Consideration of an Ordinance Amending Chapter 37 of the Lake 8:10 p.m. Forest City Code to Establish Updated Regulations for the Construction of Facilities in the Public Rights-of-Way (First Reading and Final Approval) PRESENTED BY CITY ATTORNEY VICTOR FILIPPINI Earlier this year, the City adopted standards for the construction of facilities in the public rights-of-way to address concerns regarding the use of the City's rights-of-way by cable and video service providers and other utilities. In June of this year, the General Assembly passed Public Act No. 95-0009, adopting several new laws including the Cable and Video Competition Law of 2007 (CVCL). This law established a new statewide regulatory system for cable and video service providers. In light of these changes in state law, the City Council adopted Ordinance No. 07-29, which imposed a temporary restriction on certain right-of-way construction permits while code amendments responsive to the CVCL were being developed. The Illinois Municipal League has drafted new form right-of-way construction standards that comply with the requirements of the CVCL. Attached beginning on page 52 is a proposed ordinance amending Chapter 37 of the City Code. The proposed ordinance would bring the City's right-of-way construction standards in line with the requirements of the CVCL and would repeal the temporary restriction imposed by Ordinance No. 07-29. Recommended Action: Waive first reading, and if desired by the City Council, grant final approval of an ordinance amending Chapter 37 of the City Code to establish updated regulations for the construction of facilities in the public rights-of-way. 3. Consideration of an Ordinance Amending the Lake Forest City 8:20 p.m. Code to Establish Regulations for Cable and Video Service Providers (First Reading and Final Approval) PRESENTED BY CITY ATTORNEY VICTOR FILIPPINI In addition to right-of-way construction standards, the CVCL authorizes municipalities to impose both a Service Provider Fee and a Public, Education and Government (PEG) Access Fee on providers of cable and video services holding state authorizations to provide service (as opposed to a local franchise). Public Act No. 95-0009 also enacted the Cable and Video Customer Protection Law, which provides statewide standards for customer service and consumer protection. Municipalities are authorized to adopt and enforce these standards. Attached beginning on page 89 is the proposed ordinance establishing a Service Provider Fee and a PEG Access Fee and adopting the new statewide customer service and privacy protection standards. Recommended Action: Waive first reading, and if desired by the City Council, grant final approval of an ordinance amending the Lake Forest City Code to establish regulations for cable and video service providers. 4. Consideration of an Ordinance Amending Chapter 23 of the City 8:30 p.m. Code, Licensing Requirements and Regulations, relating to Landscape and Lawncare Professionals (First Reading and Final Approval) PRESENTED BY MANAGEMENT ANALYST CARINA WALTERS (847-615-4281) The Landscape License Program was passed into ordinance by the City Council on December 4, 2006. This ordinance requires all landscape maintenance and arborist’s who desire to work within the city limits to register. The goals identified for the program were to have businesses represent quality of work provided, identify who is providing services to residents, ensure proper insurance, proper identification on their Vehicles, and create awareness within the community. Since February 2007, The City of Lake Forest has registered approximately 310 landscape maintenance companies and arborists. Attached to your council packet on page 99 is a summary report of the program. In addition to the summary report staff recommendation prior to the 2008 implementation is respectfully requesting some language modification to the ordinance. These modifications are attached beginning on page 97 of your packet. Recommended Action: Waive first reading, and if desired by the City Council, grant final approval to the ordinance amending Chapter 23 of the City Code relating to landscape and lawncare professionals. NEW BUSINESS 1. Consideration of Approval of the Route 60 Park Enhancement Project 8:40 p.m. PRESENTED BY DAN REEVES, PARKS SUPERINTENDENT (847-615-4207) Since it’s conception in May 2006, the Ad Hoc Committee has met numerous times. This report will outline some of the Committee’s objectives and review its final thoughts and action times. The Committee expects that after this report, the Ad Hoc Committee can be disbanded and City Staff can provide the implementation needs of the project. The report outlining the Committee’s objectives and findings are attached beginning on page 102 in the packet. Recommended Action: Approval of the Route 60 Park Enhancement Project as presented. 2. Discussion on Photo Enforcement Cameras 8:55 p.m. PRESENTED BY DEPUTY POLICE CHIEF GLENN BURMEISTER (847-615-4246) Police Department staff will review issues related to photo enforcement cameras that are being discussed in Cook County and at the State level. A copy of the presentation is attached beginning on page 111.
