Finance Committee Report 1. Consideration of an Ordinance Amending Chapter 39 of the City Code to Adopt a Demolition Tax (First Reading) PRESENTED BY FINANCE COMMITTEE CHAIRMAN ALD. BURNS At the December 2005 Finance Committee meeting, the Committee discussed an ordinance to amend Chapter 39 of the City Code to adopt a demolition tax. Attached beginning on page 5 is an ordinance proposing the tax, including several changes that were discussed during the Finance Committee meeting. The ordinance is proposed to be imposed upon any complete and proper application for a demolition permit filed with the City after February 15, 2006. Recommended Action: Grant first reading approval of an ordinance amending Chapter 39 of the City Code to adopt a demolition tax. January 19, 2006 Agenda Page 2 2. Consideration on an Ordinance Amending the City Code regarding Reimbursement of Third Party Costs (First Reading) PRESENTED BY FINANCE COMMITTEE CHAIRMAN ALD. BURNS At the January 3, 2006 Finance Committee meeting there was discussion on a proposed ordinance regarding the reimbursement of third part costs. Attached beginning on page 11 is a proposed ordinance amending Chapter 1 of the City Code to impose the third party costs. Recommended Action: Grant first reading approval to an ordinance regarding the reimbursement of third party costs. OPPORTUNITY FOR PUBLIC TO ADDRESS THE CITY COUNCIL 8:20 p.m. CONSENT AGENDA 8:25 p.m. 1. Approval of the Minutes from the December 5, 2005 Council Meeting: A copy of the minutes are attached beginning on page 15. Recommended Action: Approval of the Consent Agenda as presented. ORDINANCES 1. Consideration of a Report and Recommendation from the Plan 8:30 p.m. Commission and from the Historic Preservation Commission Regarding the Amberley Woods Project, a Mixed Use Development. The Recommended Actions Include Approval of an Annexation Agreement, Application of City zoning (Transitional District), Final Approval of a Plat of Subdivision, Approval of a Special Use Permit in the Form of a Final Development Plan Ordinance, and Approval of a Local Landmark Designation for the Historic Residence. The Amberley Woods Development is Proposed on a 40 Acre Parcel Located on the South Side of Route 60, between Conway Farms Drive and Saunders Road (Final Approval of Various Ordinances Subject to Conditions of Approval) STAFF CONTACTS: CITY ATTORNEY, VICTOR FILIPPINI AND DIRECTOR OF COMMUNITY DEVELOPMENT, CATHERINE CZERNIAK (847-615-4299) Background On May 28, 2003, the Historic Preservation Commission voted unanimously to recommend to the City Council approval of the local landmark designation of the Historic Residence on the Miller/Swanson property upon annexation to the City of Lake Forest. On July 13, 2005 and December 14, 2005 the Plan Commission held a public hearing and considered a request for tentative subdivision plat approval and approval of application of the City Transitional Zoning District for the Miller/Swanson property upon annexation of the property to the City of Lake Forest. As the Council is aware, this project has a long history. In summary, the current Amberley Woods development plan represents the results of several years of efforts on the part of the petitioners and their consultants. The plan as presented provides the following: January 19, 2006 Agenda Page 3 „ A mix of uses including some residential product types that do not currently exist in Lake Forest. „ A significant amount of undisturbed land including mature groves of trees and wetlands. „ The plan locates buildings away from the street frontages on Route 60 and Conway Farms Drive. „ The plan mitigates the mass of the condominium buildings through the siting of the buildings, preservation of additional trees and wetlands, and the design of the buildings. On July 13, 2005, the Plan Commission recommended tentative subdivision plat approval of the Amberley Woods development and approval of the Transitional Zoning District to the property upon annexation subject to a number of conditions of approval. On September 6, 2005, the City Council opened the public hearing on the Annexation Agreement and other related documents for Amberley Woods, the hearing was continued to allow further refinement of the documents. On December 14, 2005, the Plan Commission unanimously recommended approval of the final subdivision plat and approval of a Special Use Permit subject to a number of conditions of approval. On January 3, 2006, the City Council granted first reading of the various approval ordinances and directed that the matter be brought back for final approval with plans and documents in final form. Some work remains before the various plans are in final form in a manner consistent with the conditions of approval recommended by the Plan Commission, however, the matters that remain can be addressed quickly by the petitioner’s consultants. All final revisions should be completed prior to the Mayor signing any of the Ordinances. Recommended Actions: Grant final reading of the following ordinances. • Annexation Ordinance • Zoning Map Amendment Ordinance • Final Development Plan Ordinance (Special Use Permit) • Local Landmark Designation Ordinance All subject to the condition that the Ordinances will be signed upon the Engineering Plans, Plat of Subdivision, Plat of Annexation and Landscape Plan all being in final form and consistent with the conditions of approval as determined by the City. 2. Consideration on an Ordinance Amending the City Code regarding An Ordinance Amending Chapter 43 “Vehicles For Hire” Of The City Of Lake Forest City Code PRESENTED BY MANAGEMENT ANALYST CARINA WALTERS (847-615-4281) At the June 6, 2005 City Council meeting, an ordinance amending the City Code regulating taxi cab companies was introduced, recommending a change in insurance coverage. Representatives from the taxi companies were present, and spoke on behalf of their drivers. They stated that with the high cost of insurance, none of the drivers (for American Taxi, Yellow cab and 303 Taxi) would continue to be licensed in Lake Forest with the insurance increase. A representative of the taxi companies suggested an insurance umbrella package, would provide better insurance coverage for the residents as well as keep the costs down for the drivers. January 19, 2006 Agenda Page 4 Mayor Rummel directed staff to research whether an umbrella situation would be possible as suggested, and the Council tabled this item to a future meeting. The Illinois Compiled Statue (625 ILCS 5/8-109)(from ch. 95 ½, par. 8-109) indicates: the policy of insurance coverage may cover one or more motor vehicles and for each vehicle shall insure such owner against liability upon the owner to a minimum amount of $250,000 for- bodily injury to, or death of any person, $50,000 for damage to property, and provided that the maximum payment required of such company on all judgments recovered against an owner shall not exceed the sum of $300,000 for each motor vehicle operated under the provisions of this Section. In conducting an analysis, no other surrounding communities have or provide umbrella insurance coverage (see attached chart). The current coverage requirements in the City Code, exceeds all other communities and levels set forth in the state statue. In practice, the companies were not meeting the city’s requirement- which leads to this discussion. Upon further consideration by the City Attorney and Police personnel staff is recommending that the City Code be amended to bring insurance requirements in compliance with state statue. A copy of the proposed ordinance is attached beginning on page 20. Recommended Action: Approve first reading of an ordinance amending the City Code regarding insurance coverage for taxi cab drivers.
