The approval of a motion is required to implement the increases in various fees and charges that were recommended in the “Annual User Charge Analysis”. Included in this detailed analysis,
which is conducted annually on the several hundred user fees and charges utilized in the City, was a review of all fees and charges, permits, licenses, and fines and penalties. The
annual review of these charges ensures that the fee charged is consistent with the actual costs incurred for delivering these services.
The Finance Committee conducted a review of the “Annual User Charge Analysis” at its Finance Committee meetings on January 7th and February 4th, 2002, and recommends that the following
increases be approved and are effective for the fiscal year beginning on May 1, 2002.
Only those fees recommended for increase are noted below. A complete review of all fees charged by the City can be found in the “Annual User Charge Analysis” report, which is attached
to the Finance Committee agenda. The proposed increases are summarized below:

ORDINANCES
1. Consideration Of An Ordinance Amending The City Code Regarding Water Service Termination (First Reading) 8: 15 PM

At the November 15, 2001 City Council meeting, the City Council approved an ordinance amending the City Code to permit the termination of water service under specific circumstances.
At that time, a number of aldermen raised questions regarding the need and appropriateness for an administrative appeal process prior to any termination of service. The proposed ordinance
attached beginning on page 19 would formalize a process whereby an affected property owner could appeal a termination to service to the City Manager.
Recommended Action: Approve first reading of the proposed ordinance amending Section 44-33 of the City Code.
2. Adoption of the Revised Lake County Watershed Development Ordinance (First Reading and Final Approval) 8:25 PM

On June 19, 1992, The City of Lake Forest became the first community in Lake County to adopt the countywide Watershed Development Ordinance. This ordinance contains the minimum stormwater
and drainage standards by which all development within the county must be designed. The Lake County Stormwater Management Commission (SMC), which is the county agency responsible for
overseeing that this ordinance is being followed on a countywide basis, recognizes The City of Lake Forest as a certified community that is able to administer the ordinance on our own
with only periodic review by the SMC.
Since this ordinance was first adopted in 1992, it has been revised on three (3) other occasions (July 12, 1994; August 10, 1999; October 10, 2000). The Lake County Board adopted the
latest revisions to the Watershed Development Ordinance recommended by the SMC. These revisions involved setting the design standards for the protection of isolated wetlands, which
had been under the jurisdiction of the U.S. Army Corps of Engineers. However, last year the Supreme Court removed the U.S. Army Corps of Engineers’ jurisdiction over isolated wetlands,
but made it clear that these types of wetlands are worthy of protection and that it should be carried out by state, county, or local units of government.
Unlike the remaining sections of the Watershed Development Ordinance, the isolated wetland provisions will be enforced by the SMC. A copy of the proposed ordinance is attached as page
24.
Recommended Action: Waive first reading and grant final approval to an ordinance amending Article IV: Planning-Watershed Development of Chapter 31 “Planning” of the City Code to rescind
and replace with the adoption by reference the Lake County Watershed Development Ordinance of Lake County, Illinois as amended by the Lake County Board on August 14, 2001.
NEW BUSINESS
1. Authorization to Enter into an Agreement with McClure Engineering for Phase II Engineering Services for the Westleigh Road Rehabilitation Project 8:35 PM

Phase I (Preliminary) Engineering on the project to rehabilitate Westleigh Road has been completed. This project, which mainly involves the resurfacing of Westleigh Road between Sheridan
Road and Route 41, is ready to commence with Phase II (Plans and Specifications) Engineering. This project does not include any lane additions. McClure Engineering Associates, Inc.
is being recommended to undertake this work. McClure Engineering Associates, Inc. undertook Phase I Engineering on this project and has performed admirably on past Surface Transportation
Projects (STP) including the reconstruction of Sheridan Road (2001) and Everett Road (1993).
Compensation for Phase II Engineering Services is for a not-to-exceed amount of $34,500, which represents 5.5% of the estimated construction costs. Motor Fuel Tax (MFT) funds are proposed
to be used to fund this work, which necessitates appropriating these funds by resolution.
Upon completion of Phase II Engineering the project will be ready for Phase III, which is the Construction Phase of the project. Phase III is the phase that is eligible to receive Federal
funding assistance. The Transportation Committee of the Lake County Council of Mayors is the entity responsible for deciding on how these Federal funds are distributed on Surface Transportation
Projects (STP) in Lake County. The Westleigh Road project is currently on the Lake County Council of Mayors FY 2004 Program schedule. However, it is possible, as what occurred on the
Everett Road Reconstruction Project, that upon completion of Phase II Engineering and availability of Federal funds that the project may be undertaken earlier than the FY 2004 scheduled
time.
A copy of a map showing the project limits is attached as page 25.
Recommended Action:
It is recommended that the City enter into an Agreement with McClure Engineering for a not-to-exceed figure of $34,500 to perform Phase II Engineering Services on the Westleigh Road
Rehabilitation Project.
2. It is recommended to appropriate by resolution, $34,500 in Motor Fuel Tax funds to fund Phase II Engineering Services on the Westleigh Road Rehabilitation Project.
2. Consideration of a Resolution Appropriating Funds for the 2002 Street Resurfacing Program 8:45 PM

Engineering for the 2002 Street Resurfacing Program is complete. The City plans to resurface approximately 6.2 miles of streets this year during the summer months. The following is

The entire project is to be funded through Motor Fuel Tax (MFT) Funds. In order to stay on schedule (accept bids March 19 and award bid on April 1), it is necessary at this time to
appropriate by resolution the proposed MFT expenditure of $950,000.00. A copy of a map showing the proposed resurfacing project is attached as page 26.
Recommended Action: Approval of the resolution appropriating $950,000.00 in MFT funds toward the 2002 Street Resurfacing Program.
Award of Contract for the FY2002 and FY2003 Sanitary Sewer Lining
Project 8:55 PM

In 1999, The City of Lake Forest increased its efforts to rehabilitate the sanitary sewer system. One of the programs involved the installation of a sewer pipe that is “slip lined”
and cured inside the original deteriorated sanitary sewer pipe. Rehabilitating deteriorated sewers by this method has several advantages over the conventional method of open trenching
and replacing the deteriorated sewers. These advantages include cost savings in that lining the sewer is approximately 1/3 the cost of open trenching and that inconvenience to the public
is minimal since damage to surface features such as streets and trees are avoided.
In 1999, the low bidder was Insituform Technologies, Inc., whose bid was 10% lower than the other bidder, Visu-Sewer Clean and Seal, Inc. Insituform Technologies Inc. performed admirably
in 1999 and their contract was extended into 2000. Insituform Technologies, Inc. maintained their high level of performance and responsiveness through 2000. At this time, it is being
recommended that The City of Lake Forest continue to use Insituform Technologies, Inc. to perform lining rehabilitation of sanitary sewers during the current fiscal year (FY2002) up
to a maximum amount of $400,000 as well as the upcoming fiscal year (FY2003) up to a maximum of $500,000. The proposed contract with Insituform Technologies, Inc. is structured where
it is on an as-needed basis with prices based on the amount of sanitary sewer lining work undertaken. Prices on this proposed contract are approximately 0.8% higher than those in the
1999-2000 contract. The contract upper limit amounts will allow for approximately 5 miles of sanitary sewer to be rehabilitated which will be undertaken in areas that have recently
been smoke tested and televised.
Rehabilitation of the sanitary sewers will not only improve the operation of the system, but reduces the amount of infiltration/inflow of stormwater into the system which contributes
toward surcharging and ultimately basement back-ups.
Recommended Action: It is recommended to enter into a contract with Insituform Technologies, Inc. to perform sanitary sewer rehabilitation through cured-in-place lining up to a maximum
amount of $400,000 for FY 2002 as well as a maximum amount of $500,000 for FY 2003.
