CONSENT AGENDA
1. Approval of the Minutes from the June 7, 1999 Meeting
The minutes are attached beginning on page 4.
2. Consideration of an Ordinance Amending Chapter 39 of The City Code of The City of Lake Forest Imposing a Tax on the Usage or Consumption of Electricity in The City of Lake Forest
(Second Reading and Final Approval)
At its June 7, 1999 meeting, the City Council granted first reading approval to an Ordinance terminating the current gross receipts based electric tax, and creating a new electric tax
based on consumption. This was done in response to the requirements of the Electric Customer Choice and Rate Relief Law of 1997, which the Illinois General Assembly enacted in December
of 1997. The consumption based tax will protect the City’s tax revenue stream in the face of potentially declining costs for electric service due to deregulation.
Attached beginning on page 8 of the packet is the ordinance repealing the gross receipts tax, and imposing the new consumption based tax.
Recommended Action: Approval of the Consent Agenda items as presented.
NEW BUSINESS
1. Consideration of an Ordinance Adopting the State Gift Ban Act (Second Reading and Final Approval)
PRESENTED BY CITY MANAGER ROBERT R. KIELY, JR. (615-4271)
In 1998, the Illinois State Legislature approved the State Gift Ban Act. The Act was effective January 1, 1999 but the legislation stipulated that local governments were not required
to come into compliance until July 1, 1999. The Illinois Municipal League (IML) and Northwest Municipal Conference (NWMC) expected the General Assembly to revisit this issue in 1999
spring season, so they suggested that communities hold off adopting the required ordinance. Despite the introduction of some clarifying legislation and intense lobbying by the IML and
NWMC, the Act was not modified.
The City Attorney has prepared a draft ordinance, modeled after an ordinance prepared by IML, and attached hereto beginning on page 12. Two specific questions that the City Council
must decide are; 1) who will be the Ethics Officer; and 2) the exemption of non-salaried elected and appointed in September 1999 applied to these non-salaried officials. Regarding the
Ethics Officer, this is an administrative position and the Director of Human Resources was selected since she handles a similar function for City staff.
Recommended Action: Approve second reading and final approval of an ordinance prohibiting the solicitation and acceptance of gifts - State Gift Ban Act.
2. Discussion on The City of Lake Forest’s Governmental Ethics Ordinance
Mayor Kerr asked at the June 7 City Council meeting that the City Council review the current Ethics Ordinance as it applies to appearances before City Boards, Commission, etc. (see
paragraph VI on page 3 of the ordinance). The question has been raised by some members as to whether this precludes them from appearing before other Boards and Commissions or if it
excludes someone from their firm or company appearing before other Boards and Commissions. Mayor Kerr is seeking input from the City Council as to whether this or other sections of
the Ethics Ordinance need further consideration or clarification. The Ethics Ordinance is attached as page 52.
3. Consideration of a Resolution for Postponement of Consideration of Petitions within the Route 60 Corridor
PRESENTED BY CITY MANAGER ROBERT R. KIELY, JR. (615-4271)
Mayor Kerr at the May 20 Committee of the Whole and June 7 regular City Council meetings raised the possibility of deferring any consideration of petitions within the Route 60 corridor
area until such time as a complete management plan has been adapted. This recommendation will be presented to the various businesses within the designated area prior to Thursday night’s
meeting.
Attached beginning on page 59 is a copy of the resolution postponing the consideration of petitions within the Route 60 corridor.
Recommended Action: Approve the resolution as attached.
