A Resolution Certifying Compliance with the Illinois Prevailing Wage Law The Illinois Compiled Statutes require that any public body awarding contracts for public work or work by day labor shall annually ascertain the general prevailing hourly rate of wages for employees engaged in such work. The Statutes further provide that these rates of pay shall be publicly posted or be made available for inspection and a certified copy filed with the Secretary of State. The resolution attached as page 5 recommended for approval certifies that the City does pay the prevailing hourly rate of wages and fulfills the required compliance with State Statutes. C. Comments by Council Members PUBLIC COMMENTS ON NON-AGENDA ITEMS APPROVAL OF MINUTES Recommended Action: Approval of the minutes of the June 1,1998 Council meeting attached beginning on page 7. ORDINANCES 1. Consideration of a Report and Recommendation from the Zoning Board of Appeals Regarding a Special Use Permit to allow an educational use in the Two Conway Park office building at 150 Field Drive, in the OR-2, Office Research District (First Reading and Final Approval) PRESENTED BY SENIOR PLANNER CATHERINE CZERNIAK (615-4299) On May 26, 1998 the Zoning Board of Appeals held a public hearing on a request for a Special Use Permit to allow DePaul University to locate a suburban campus in the Two Conway Park office building, now under construction, located on the northeast corner of Route 60 and the Tollway. Mr. David Justus, representing DePaul University, explained the University's interest in offering various programs at the proposed Lake Forest campus including Public Service Management, Nursing, and computer classes. The classes will be held in the evenings and on weekends and will serve an exclusively adult, part-time student population. DePaul University is proposing to use 11,000 square feet of space on the first floor of the building for 7 classrooms, with a goal of reaching 200 students. The Board discussed a variety of issues including the impact of the classes on peak traffic hours, the parking needs generated by the use, the potential for future expansion of the University, and whether the proposed program offerings would duplicate those currently available through other institutions in Lake Forest. After discussion, the Board voted unanimously to approve the Special Use Permit subject to several conditions to address the hours classes will be held and the potential for future expansion of the campus. The Board’s report is attached beginning on page 15. The ordinance for the Special Use Permit, with findings and conditions, is attached beginning on page 11. Recommended Actions: Grant first reading and final approval to an ordinance granting the Special Use Permit. 2. Consideration of a Report and Recommendation from the Zoning Board of Appeals Regarding a Request for Front and Side Yard Setback Variations for Property Located at 158 E. Park Avenue (Dvorak Variation) (First Reading and Final Approval) PRESENTED BY SENIOR PLANNER CATHERINE CZERNIAK (615-4299) On May 26, 1998 the Zoning Board of Appeals held a public hearing on a request for a setback variation for property located at 158 E. Park Avenue. Mr. Tom Hoept, architect, introduced the project explaining that the existing house and garage encroach into the front and side yard setbacks. He pointed out that the proposed addition would not extend beyond the existing footprint of the house with the exception of a chimney that would be added on the west side of the house. In response to a concern raised by a neighboring property owner, the Board discussed the height and location of the proposed chimney. The Board also discussed the overall height of the house with the addition, and agreed that Building Review Board consideration of the proposal should be required to ensure that the height will be compatible with the neighborhood. The Zoning Board of Appeals voted unanimously to recommend approval of the variation subject to a condition requiring Building Review Board approval of the project. The Board’s report is attached beginning on page 25. The ordinance with findings is attached beginning on page 22. Recommended Action: Grant first reading and final approval to an ordinance granting the setback variations. 3. Consideration of a Report and Recommendation from the Zoning Board of Appeals Regarding a Request for a Front Yard Setback Variation for Property Located at 780 Lake Road (McLaughlin Variation) (First Reading and Final Approval) PRESENTED BY SENIOR PLANNER CATHERINE CZERNIAK (615-4299) On May 26, 1998 the Zoning Board of Appeals held a public hearing on a request for a setback variation for property located at 780 Lake Road. Mrs. Carolyn McLaughlin, property owner, introduced the petition. She described the major renovation of the house that was previously approved by the City and now underway. She explained that on the approved site plan, the garage was located to conform to the setback requirement. However, after further consideration, she determined that a slight shift in the alignment of the garage, consistent with the alignment of the existing house and the original setback on the property, would improve the overall project. She requested approval of a front yard variation to allow the garage to be shifted toward Deerpath. There were no public comments on the petition. The Zoning Board of Appeals voted unanimously to recommend approval of the variation. The Board’s report is attached beginning on page 38. The ordinance with findings is attached beginning on page 35. Recommended Action: Grant first reading and final approval to an ordinance granting the setback variation. UNFINISHED BUSINESS NEW BUSINESS 1. Consideration of a Report and Recommendation from the Plan Commission for Final Approval of a 50-Lot Subdivision for Property Located South of Route 60, on the East Side of Conway Farms Drive. (The Courts at Conway Farms) PRESENTED BY SENIOR PLANNER CATHERINE CZERNIAK (615-4299) On May 13, 1998 the Plan Commission held a public hearing on a request for final approval of The Courts at Conway Farms, a 50-lot subdivision. This subdivision represents one of the remaining phases of development in Conway Farms. Mr. Gene Corely, representing The Courts of Conway Farms, L.L.C., requested Plan Commission approval based on the fact that the conditions of tentative approval had been satisfied. The Plan Commission voted unanimously to recommend final approval of the subdivision to the City Council subject to the conditions as recommended by staff. The Commission's report is attached beginning on page 48. Recommended Action: Grant final approval of the subdivision. 2. Award of a Contract to McClure Engineering Associates for the Arcady/Farm Storm Sewer Improvement Project - Engineering Services Agreement PRESENTED BY CITY ENGINEER KEN MAGNUS (615-4329) In 1991, an analysis was undertaken on the entire storm sewer system of the City. This analysis identified the deficiencies in the storm sewer system and recommended improvements. To date, the City has undertaken eight (8) of these improvement projects at a cost of over $3,200,000. Included in the recommended improvements are two (2) improvements located on both Arcady Drive and Farm Road. The recommended improvements involve upgrading the existing storm sewer systems in these areas to the minimum 10-year storm design standard. In order to undertake this work, it is necessary at this time to procure the services of an engineering firm to prepare the plans and specifications. The engineering firm of McClure Engineering Associates, Inc. is being recommended to undertake this work for a not-to-exceed amount of $78,000.00. This amount represents approximately 7.5% of the estimated construction cost of the project. McClure Engineering Associates, Inc. has previous experience working in this area (Everett Road Reconstruction Project; TIF Area Improvements), where their work was determined to be commendable. It is anticipated that the plans and specifications would be completed and ready for bidding in February 1999, with construction to be undertaken during the Spring/Summer of 1999. Recommended Action: Award the Engineering Services Contract for the Arcady/Farm Storm Sewer Improvement Project, to McClure Engineering Associates, Inc. for a not-to-exceed figure of $78,000.00.
