Recommended Action: Approval of the minutes of the January 5, 1998 Council meeting.
ORDINANCES
1. Consideration of a Building Inspection Services Agreement with the Village of Mettawa
PRESENTED BY CITY MANAGER ROBERT R. KIELY, JR (615-4271)
For a number of years, The City of Lake Forest has been providing building inspection services to the Village of Mettawa on a fee basis. The previous agreement expired in 1995 and the
parties have been operating under the terms of the old agreement while the attorneys and staff update and revise the contract language. The only notable change pertains to Sections
I. (A)(1) and (2), relating to concerns raised by the Village of Mettawa regarding the issuance of building permits until it is verified by the petitioner that their is a valid lot of
record. City staff was reluctant to take on the investigative burden of determining whether lots were buildable or not and any whether any zoning violations existed on said lot. Therefore,
through mutual agreement, the burden of proof has been shifted to the petitioner. Attached beginning on page 6 is a copy of the proposed new agreement.
Recommended Action: Approve the building inspection services agreement between The City of Lake Forest and the Village of Mettawa.
2. Consideration of an Ordinance Annexing the Eastern Half of the Tollway Property North of Everett Road (Second Reading and Final Approval) and an Intergovernmental Agreement Between
the City and Village of Mettawa

At its October 6, 1997 meeting, the City Council held a public hearing and approved first reading of an ordinance annexing the eastern half of the Illinois State Toll Highway right-of-way
north of Everett Road to the Lake Forest Oasis. Although it passed first reading the City Council questioned the impact the annexation would have on the provision of public safety services
and anticipated revenue expected to be received from the annexation of the oasis property. Since that meeting, City staff has been meeting with representatives of the Village of Mettawa
(who are in the process of annexing the western half of the tollway property) and the Illinois State Toll Highway Authority. The Toll Highway Authority had reservations regarding the
splitting of the oasis property between the Village of Mettawa and The City of Lake Forest. By mutual consent, the parties have agreed that the Village of Mettawa would annex the tollway
oasis under the condition that a intergovernmental agreement be executed between the Village and City, splitting the revenues received from the subject property. Therefore, The City
of Lake Forest will not be responsible for responding to calls to the oasis property, but only the northbound lane of the tollway from Everett Road to the oasis. The Libertyville Fire
Protection District will continue to be responsible for all calls to the tollway oasis. The Toll Highway Authority will reimburse the City $300 for any call on tollroad property. A
copy of the ordinance and intergovernmental agreement is attached on page 20.
Recommended Action: 1) Approve second reading and final approval of the proposed ordinance annexing the eastern half of the Illinois State Toll Highway right-of-way; and 2) Approve
the intergovernmental agreement with the Village of Mettawa.
3. Consideration of an Ordinance Amending Chapter 26 of the City Code Prohibiting the Sale, Purchase, Possession, and Use of Tobacco Products by Minors (Second Reading)

On October 16, 1997, the City council gave first reading approval to an ordinance prohibiting the possession and use of tobacco products by minors in prohibiting the possession and use
of tobacco products by minors in Lake Forest. Subsequent to first reading approval, a meeting to discuss this ordinance was held with community leaders, including representatives of
Lake Forest Hospital, School District 67, School District 115, the Village of Lake Bluff and Police. Communities which already have a teen smoking prohibition were also contacted for
information on their experience.
The City Attorney has redrafted the ordinance, a copy of which is attached beginning on page 24. The major components of the ordinance are as follows:
It shall be unlawful for a minor to purchase, possess or use tobacco products unless the direct control and supervision of a parent in the privacy of their home;
Cigarette vending machines are prohibited in Lake Forest (there currently are none in Lake Forest);
A tobacco dealer’s license must be obtained in order to sell tobacco products in Lake Forest;
Tobacco dealers must prominently display a notice stating the prohibition of tobacco products to minors;
Minors violating the ordinance will be fined $100 for the first offense; $200 for the second, and $300 for each subsequent offense;
In addition to, or in lieu of payment of a fine, the violator may be required to do community service;
If a tobacco dealer violates the ordinance, a fine will be imposed; second and subsequent offenses will result in suspension of their license.
Also attached beginning on page are articles on teen smoking which appeared in the local press and a letter from State Representative Corrine Wood supporting a local ordinance.
Recommended Action: Final approval of an ordinance amending Chapter 26 to prohibit the sale, purchasing, possession and use of tobacco products.

NEW BUSINESS
1. Consideration of Seasonal Starting Time Procedures for Deer Path Golf Course
PRESENTED BY DIR. OF PARKS, FORESTRY & PUBLIC WORKS TOM NAATZ (615-4218)
On October 21, 1997, the Park and Recreation Board discussed starting time procedures for Deer path Golf Course. The Board recommended two changes for the 1998 procedures. First, all
special privileges associated with the category “Established Groups” would cease (the ability of certain groups to obtain the same time year to year providing their group remains consistent).
Second, the 1998 lottery system would be based upon seasonal resident membership (1997 lottery based upon membership only regardless of whether you were a resident or non-resident).
Due to the fact this was a non-agenda item the issue was brought back to the Board at their December meeting. Following committee and public discussion the Bard approved the recommended
changes to the starting time policy.
Recommended Action: It is the recommendation of the Parks and Recreation Board to eliminate the Established Foursome category for securing seasonal starting times at Deer Path Golf
Course and establish a lottery system based upon seasonal resident membership.
