Recommended Action: Approval of the minutes of the July 1, 1996 Council meeting attached beginning on page 4.

a. Consideration of the Annual Appropriation Ordinance for FY1997 (Final Reading)
While the annual municipal budget represents the City’s financial “plan” for expenditures over the course of the fiscal year, the annual Appropriation Ordinance is the formal legal mechanism
by which the City Council authorizes the actual expenditure of funds budgeted in the annual budget. It appropriates specific sums of money by object and purpose of expenditure. State
statutes require the passage of an Appropriation Ordinance which must be filed with the County Clerk by the end of July.
In addition, the Appropriation Ordinance provides for a 10% “contingency” in the expenditures in an amount above those actually budgeted. Each separate fund includes an item labeled
“contingency," with an appropriate sum equivalent to 10% of the total funds budgeted. This practice has been followed for the past seventeen years and has worked very efficiently, while
still providing for complete City Council control over budgeted expenditures. Importantly, the City Council and City staff follow the adopted budget as its spending guideline, not the
Appropriation Ordinance.
Without the contingency, the City Council would have to pass an amended Appropriation Ordinance to cover any unforeseen expenditures exceeding the budget. School District 67 does not
incorporate a contingency in their budget.

The proposed ordinance received first reading approval on July 1, 1996. A copy of the ordinance is available for review in the City Clerk’s office.
Recommended Action: Final approval of the FY1997 Appropriation Ordinance.

b. Consideration of a Report and Recommendation from the Plan Commission Regarding a Request for Approval of a 15-lot Planned Preservation Subdivision and Necessary Special Use Permit
for Property Located at 1915 S. Telegraph Road (James Property) (Tentative Approval and First Reading)
PRESENTED BY SENIOR PLANNER ANDREW M. SUVALSKY
Mr. Steven Christy and Mr. Jim Richter, representing the petitioner, the Lake Forest Open Lands Association, appeared before the Plan Commission at its regular meeting on May 8, 1996,
to request tentative approval of a 22-lot planned preservation subdivision with a variation to allow a 50 foot right-of-way for the subdivision.
The Plan Commission reviewed the matter and voted unanimously to approve the subdivision subject to several conditions which are outlined in the hearing report and special use permit
ordinance attached beginning on page 8.
Subsequent to that meeting, the petitioner revised the plan to eliminate 7 of the 22 proposed lots. Therefore, the current plan calls for 15 lots in similar configuration to the original
submittal.
Attached beginning on page 8 is the report and recommendation from the Plan Commission as well as information relating to each plan.
Recommended Action: Grant tentative approval to the 15-lot planned preservation subdivision and first reading approval of the necessary special use permit ordinances subject to the
conditions outlined in the hearing report.
