SPECIAL MEETING - SATURDAY, MAY 14, 1988 AT 8:30 A.M.
COUNCIL CHAMBER CITY HALL - LAKE FOREST, ILLINOIS
A special meeting of the City Council of The City of Lake Forest, Lake
County, Illinois was held on Saturday, May 14, 1988 at 8:30 a.m. in the Council
Chamber of City Hall of The City of Lake Forest pursuant to call and notice of
call each of which is attached hereto:
I. CALI. TO ORDER: The Honorable Marshall C. Strenger, Mayor, was present
and called the meeting to order. There were 13 people present in the
audience.
II. ROLL CALL: The City Clerk called the roll of City Council members.
The following aldermen were present: Johnson, Davies, Galloway,
Woloson and Gallagher. The following aldermen were absent:
Fassnacht, Morrison and Elting. Quorum present.
John F. Fischbach, City Manager; Murray R. Conzelman, City Attorney;
Charles E. Crook, Director of Planning and Development; Steve Lutz,
Rosemary Haack, DeSha Brandt, Assistants to the City Manager; Susan
Janzen, Executive Secretary; Char Kreuz, Director of Communications
and Public Information; and Robert D. Shaffer, Director of Finance,
were also present.
III. COMMENTS BY COUNCIL MEMBERS: None.
IV. COMMENTS BY THE CITY MANAGER: The City Manager reviewed a slide
presentation of the west side water tower construction.
V. CONSENT AGENDA:
A. Approval of the Minutes of the Regular_Meetof the City
Council Held_ on_May _2,1988.
B. Acceptance of Conway Park Water Main Improvements.
C. Authorization for Expenditure of Motor Fuel Funds for the
1988 Street Resurfacing -Projects.
D. RESOLUTION 1982 - Authorizing the Mayor and City Clerk to Sig
a License Agreement with the Chicago and North Western
Transportation Compat for Water _Main Construction_ at Laurel

Alderman Johnson made a motion that the Consent Agenda be approved as
presented. The motion was seconded by Alderman Davies. Upon a roll
call vote, the following alderman voted "yea": Johnson, Davies,
Galloway, Woloson and Gallagher. The following aldermen voted "nay':
None. Aldermen Fassnacht, Morrison and Elting were absent. The
Consent Agenda was approved.
VI. ORDINANCE 1763 - GRANTING A VARIATION FROM THE FRONT AND INTERIOR SIDE
YARD SETBACK VARIATIONS FOR PROPERTY LOCATED AT 52 E. ATTERIDGE ROAD:
Alderman Johnson made a motion that an ordinance entitled "An
Ordinance Granting a Variation from Section 46-38-D of the Lake Forest
Zoning Code With Respect to Property Located at 52 E. Atteridge Road",
which was first introduced and read at the meeting of May 2, 1988, be
passed. The motion was seconded by Alderman Galloway. Upon a roll
call vote, the following alderman voted "yea': Johnson, Davies,
Galloway, Woloson and Gallagher. The following aldermen voted "nay":
None. Aldermen Fassnacht, Morrison and Elting were absent. The
ordinance was approved.
VII. ORDINANCE 1764 - GRANTING A VARIATION FROM THE FRONT YARD, INTERIOR
SIDE YARD AND REAR YARD SETBACK VARIATIONS FOR THE PROPERTY LOCATED AT
226 E. NOBLE AVENUE: Alderman Johnson made a motion that an ordinance
entitled "An Ordinance Granting a Variation from Section 46-40-E of
the Lake Forest Zoning Code With Respect to Property Located at 226 E.
Noble Avenue", which was first introduced and read at the meeting of
May 2, 1988, be passed. The motion was seconded by Alderman Davies.
Upon a roll call vote, the following alderman voted "yea": .Johnson,
Davies, Galloway, Woloson and Gallagher. The following aldermen voted
"nay': None. Aldermen Fassnacht, Morrison and Elting were absent.
The ordinance was approved.
VIII. ORDINANCE 1765 - AMENDING SECTION 9-A(d) OF ARTICLE II, CHAPTER 1, OF
THE BUILDING CODE OF LAKE FOREST OF 1931, AS AMENDED, TO INCREASE THE
NUMBER OF MEMBERS ON THE BUILDING REVIEW BOARD: Alderman Johnson made
a motion that an ordinance entitled "An Ordinance Amending Section
9-A(d) of Article II, Chapter 1, of the Building Code of Lake Forest,
1931, As Amended", which was first introduced and read at the meeting
of May 2, 1988, be passed. The motion was seconded by Alderman
Gallagher. Upon a roll call vote, the following alderman voted "yea":
Johnson, Davies, Galloway, Woloson and Gallagher. The following
aldermen voted "nay': None. Aldermen Fassnacht, Morrison and Elting
were absent. The ordinance was approved.
IX. ORDINANCE 1.766 - APPROVING A TAX INCREMENT REDEVELOPMENT PLAN AND
REDEVELOPMENT PROJECT IN THE CITY OF LAKE FOREST: Alderman Gallagher
made a motion that an ordinance entitled "An Ordinance Approving a Tax
Increment Redevelopment Plan and Redevelopment Project in The City of
Lake Forest, Illinois", which was first introduced and read at the
meeting of May 2, 1988, be passed. The motion was seconded by
Alderman Johnson. Upon a roll call. vote, the following alderman voted "yea":
Johnson, Davies, Galloway, Woloson and Gallagher. The following
aldermen voted "nay': None. Aldermen Fassnacht, Morrison and Elting
were absent. The ordinance was approved.

X. ORDINANCE 1767 - DESIGNATING A REDEVELOPMENT PROJECT AREA AND ADOPTING
TAX INCREMENT ALLOCATION FINANCING IN THE CITY OF LAKE FOREST:
Alderman Gallagher made a motion that an ordinance entitled "An
Ordinance Designating a Redevelopment Project Area and Adopting Tax
Increment Allocation Financing in The City of Lake Forest, Illinois",
which was first introduced and read at the meeting of May 2, 1988, be
passed. The motion was seconded by Alderman Johnson. Upon a roll
call vote, the following alderman voted "yea": Johnson, Davies,
Galloway, Woloson and Gallagher. The following aldermen voted "nay":
None. Aldermen Fassnacht, Morrison and Elting were absent. The
ordinance was approved.
XI. ORDINANCE 1768 - AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, TO DECREASE
THE NUMBER OF CLASS D/D1 LIQUOR LICENSES BY ONE: John F. Fischbach,
City Manager, introduced and read an ordinance entitled "An Ordinance
Amending Chapter 4, Alcoholic Beverages, of the City Code of Lake
Forest, 1971, As Amended." A motion was made by Alderman Galloway
that the first reading of the ordinance be accepted and acknowledged,
and that the ordinance be held on file by the City Clerk for second
reading and action thereupon. The motion was seconded by Alderman
Gallagher and carried unanimously.
XII. REPORT AND RECOMMENDATION FROM THE ZONING BOARD OF APPEALS REGARDING A
CORNER SIDE YARD SETBACK VARIATION FOR PROPERTY LOCATED AT 425
AHWAHNEE ROAD: Charles E. Crook, Director of Planning and
Development, reviewed the report and recommendation of the Zoning
Board of Appeals regarding a corner side yard setback variation for
property located at 425 Ahwahnee Road. Alderman Johnson requested
that she be allowed to abstain from discussion on this matter.
Alderman Gallagher made a motion to authorize Alderman Johnson to
abstain from discussion on this matter. The motion was seconded by
Alderman Davies and carried unanimously.
Upon discussion by members of the City Council, Alderman Galloway made
a motion to accept the report and recommendation of the Zoning Board
of Appeals regarding a corner side yard setback variation for property
located at 425 Ahwahnee Road. The motion was seconded by Alderman
Woloson and carried. Alderman Johnson abstained.
ORDINANCE 1769 - GRANTING A VARIATION FROM THE SIDE YARD SETBACK
REQUIREMENTS FOR PROPERTY LOCATED AT 425 AHWAHNEE ROAD: Charles E.

entitled "An Ordinance Granting a Variation from Section 46-35-D of

reading of the ordinance be accepted and acknowledged, and that the
ordinance be held on file by the City Clerk for second reading and
action thereupon. The motion was seconded by Alderman Woloson and
carried. Alderman Johnson abstaining.
XIII. REPORT AND RECOMMENDATION OF THE ZONING BOARD OF APPEALS REGARDING A
CORNER SIDE YARD SETBACK VARIATION FOR THE PROPERTY LOCATED AT 91
WASHINGTON CIRCLE: Charles E. Crook, Director of Planning and
Development, reviewed the report and recommendation of the Zoning

Board of Appeals regarding a corner side yard setback variation for
property located at 91 Washington Circle. Alderman Galloway made a
motion to accept the report and recommendation of the Zoning Board of
Appeals. The motion was seconded by Alderman Johnson and carried
unanimously.
ORDINANCE 1770 - GRANTING A VARIATION FROM THE SIDE YARD SETBACK
REQUIREMENTS FOR PROPERTY LOCATED AT 91 WASHINGTON CIRCLE: Charles E.
Crook, Director of Planning and Development, introduced an ordinance
entitled "An Ordinance Granting a Variation from Section 46-40-E of
the Lake Forest Zoning Code With Respect to Property Located at-91
Washington Circle. Alderman Galloway made a motion that the first
reading of the ordinance be accepted and acknowledged, and that the
ordinance be held on file by the City Clerk for second reading and
action thereupon. The motion was seconded by Alderman Johnson and
carried unanimously.
XIV. REPORT AND RECOMMENDATION FROM THE PLAN COMMISSION REGARDING A 20-LOT
SUBDIVISION LOCATED ON THE SOUTH SIDE OF OLD MILL ROAD AND WEST OF THE
CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD RIGHT-OF-WAY
(TENTATIVE APPROVAL): Charles E. Crook, Director of Planning and
Development, reviewed the tentative plat of subdivision for a 20-lot
subdivision located on the south side of Old Mill Road and west of the
Chicago, Milwaukee, St. Paul and Pacific Railroad right-of-way. Upon
discussion by members of the City Council, Alderman Gallagher made a
motion to grant tentative approval of the subdivision. The motion was
seconded by Alderman Davies and carried. Alderman Johnson voting nay.
XV. REPORT AND RECOMMENDATION FROM THE ZONING BOARD OF APPEALS REGARDING
INTERIOR SIDE YARD SETBACK VARIATION FOR PROPERTY LOCATE➢ AT 1776 S.
TELEGRAPH ROAD: Charles E. Crook, Director of Planning and
Development, reviewed the report and recommendation of the Zoning
Board of Appeals regarding the interior side yard setback variation
for property located at 1776 S. Telegraph Road. Alderman Gallagher
made a motion to accept the report and recommendation of the Zoning
Board of Appeals. The motion was seconded by Alderman Davies and
carried unanimously.
ORDINANCE 1771 - GRANTING A VARIATION FOR PROPERTY LOCATED 1776 S.
TELEGRAPH ROAD: Charles E. Crook, Director of Planning and
Development, introduced an ordinance entitled "An Ordinance
Granting a Variation from Section 46-35-D of the Lake Forest Zoning
Code With Respect to Property Located at 1776 S. Telegraph Road."
Alderman Gallagher made a motion that the first reading of the
ordinance be accepted and acknowledged, and that the ordinance be held
on file by the City Clerk for second reading and action thereupon.
The motion was seconded by Alderman Davies and carried unanimously.
XVI. APPROVAL OF AN ll-LOT SUBDIVISION LOCATED AT APPROXIMATELY 580 S.
WAUKEGAN ROAD (FINAL APPROVAL): Charles E. Crook, Director of
Planning and Development, reviewed the Gavin Woods 11-lot subdivision
located at approximately 580 S. Waukegan Road. Upon discussion,
Alderman Gallagher made a motion to grant final approval of: the 11-lot
subdivision. The motion was seconded by Alderman Galloway and
carried. Alderman Johnson voting nay.

XVII. BIDS FOR THE PURCHASE OF A TOWABLE ASPHALT HEATER AND STORAGE UNIT FOR
THE STREET SECTION: John F. Fischbach, City Manager, reviewed the bid
of Weltzin and Co. of Libertyville for $36,681.40. Alderman Davies
made a motion to award the bid to Weltzin and Co. on their bid of
$36,681.40. The motion was seconded by Alderman Johnson. Upon a roll
call vote, the following aldermen voted "yea": Johnson, Davies,
Galloway, Woloson and Gallagher. The following aldermen voted "nay":
None. Aldermen Fassnacht, Morrison and Elting were absent. The award
was approved.
XVIII. BIDS TO LINE AN EXISTING WATER MAIN IN THE ROUTE 60 RIGHT-OF-WAY: The
City Manager reviewed the following bids:

Pipe -Liners', Ltd. $211,700.00
Alderman Galloway made a motion to award to Ace Pipe Cleaning, Inc. on
their bid of $185,173.85. The motion was seconded by Alderman
Johnson. Upon a roll call vote, the following aldermen voted "yea":
Johnson, Davies, Galloway, Woloson and Gallagher. The following
aldermen voted "nay": None. Aldermen Fassnacht, Morrison and Elting
were absent. The award was approved.
XIX. BIDS FOR OLD MILL ROAD BRIDGE: The City Manager reviewed the
following bids:

Alderman Galloway made a motion to award the bid to Eric Bolander
Construction Company on the low bid of $37,382.50. The motion was
seconded by Alderman Johnson. Upon a roll call vote, the following
aldermen voted "yea": Johnson, Davies, Galloway, Woloson and
Gallagher. The following aldermen voted "nay": None. Aldermen
Fassnacht, Morrison and Elting were absent. The award was approved.
XX. OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE CITY COUNCIL: None.
XXI. CONVENE INTO EXECUTIVE SESSION: Alderman Johnson made a motion to
convene into Executive Session to discuss pending litigation and land
acquisition as authorized by Section 42, Chapter 101 of the Illinois
Revised Statues. The motion was seconded by Alderman Gallagher and
carried unanimously.
