CITY COUNCIL 1988/10/15 Minutesss Proceedings of the City Council of THE CITY OF LAKE FOREST SPECIAL MEETING - SATURDAY, OCTOBER 15, 1988 AT 8:30 A.M. COUNCIL CHAMBER - CITY HALL - LAKE FOREST, ILLINOIS A special meeting of the City Council of The City of Lake Forest, Lake County, Illinois was held on Saturday, October 15, 1988 at 8:30 a.m. in the Council Chamber of City Hall of The City of Lake Forest pursuant to call and notice of call, each of which is attached hereto: I. CALL TO ORDER: The Honorable Marshall C. Stronger, Mayor, was present and called the meeting to order. There were 28 people present in the audience. II. ROLL CALL: The City Clerk called the roll of City Council members. The following aldermen were present: Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following alderman was absent: Galloway. Quorum present. John F. Fischbach, City Manager; Murray R. Conzelman; City Attorney; Charles E. Crook, Director of Planning and Development; Robert D. Shaffer, Director of Finance; John J. Fisher, Personnel Director; Steve Lutz, Rosemary Haack and DeSha Brandt, Assistants to the City Manager; and Char Kreuz, Director of Communications and Public Information, were also present. III. COMMENTS BY COUNCIL MEMBERS: None. IV. COMMENTS BY CITY MANAGER: The City Manager reported on the possible closings of both Fort Sheridan and the Great Lakes Naval Base. He also gave an update on the Lake County Joint Action Solid Waste Planning Agency. V. CONSENT AGENDA: A. Approval of the Minutes of the Regular Meeting of the City Council Held on October 3, 1988. B. Granting a One Year Extension for Tentative Approval for the Stanton Subdivision. Alderman Johnson moved to approve the Consent Agenda, as presented. The motion was seconded by Alderman Morrison. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. ORDINANCE 1798 - AN ORDINANCE ANNEXING APPROXIMATELY 506 ACRES OF TERRITORY GENERALLY LOCATED SOUTH OF ILLINOIS ROUTE 60, WEST OF THE CORPORATE LIMITS OF THE CITY OF LAKE FOREST, AND SOUTHEAST OF SAUNDERS ROAD: John F. Fischbach, City Manager, reviewed an ordinance entitled, An Ordinance Annexing Approximately 506 Acres of Territory Generally Located South of Illinois Route 60, West of the Corporate Limits of The City of Lake Forest, and Southeast of Saunders Road", which was introduced and read at the meeting of October 3, 1988. Al Glover of 254 Park Avenue asked permission to read a letter which he had written, a copy of which is attached hereto and made a part of these proceedings. Also speaking on the issue were Robert Pasquesi of 172 Washington Road; Phelps Langtry of 1015 Ridge Road; Susan Dart McCutcheon of 281 West Laurel Avenue; and Betty Jane Saville of 340 Linden Avenue. Following the discussion, Alderman Johnson made a motion that the ordinance be passed. The motion was seconded by Alderman Elting. upon a roll call vote, the following voted "yea": Mayor Strenger, Aldermen Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. The ordinance was declared passed. VII. ORDINANCE 1790 - AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW A PLANNED HISTORIC PRESERVATION DEVELOPMENT SUBDIVISION WITH REGARD TO PROPERTY LOCATED AT 410-420-430 WASHINGTON ROAD (ALLING) (FINAL APPROVAL): A motion was made by Alderman Fassnacht that an ordinance entitled, "An Ordinance Granting a Special Use Permit to Allow a Planned Historic Preservation Development Subdivision with Regard to Property Located at 410-420-430 Washington Road", which was introduced and read at the meeting of June 13, 1987, be passed. The motion was seconded by Alderman Davies. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. The ordinance was declared passed. Alderman Fassnacht moved to grant final approval to the plat of subdivision. The motion was seconded by Alderman Davies and carried unanimously. VIII. ORDINANCE AUTHORIZING THE SALE OF $3.9 MILLION OF CERTIFICATES OF PARTICIPATION: Steve Lutz, Assistant to the City Manager, reviewed the three ordinances authorizing the proposed construction projects. ORDINANCE 1791-A (STREET LIGHTS): AN ORDINANCE APPROVING INSTALLMENT PURCHASE CONTRACTS AND RELATED MATTERS INCLUDING THE FINANCING: Alderman Johnson moved that the first reading of an ordinance entitled, "An Ordinance Approving Installment Purchase Contracts and Related matters Including the Financing Therefor in Connection with the City -Wide Street Light Rehabilitation Project, the Forest Park Beach Project and the Municipal Services Center Project, in and for The City of Lake Forest, Lake County, Illinois and providing for the Levy and Collection of Direct Annual Taxes to Pay the Periodic Installments Provided for by Such Contracts", be accepted and Proceedings of the City Council Special Meeting -- Saturday, October 15, 1988 acknowledged, and that the ordinance be held on file by the City Clerk for second reading and action thereupon. The motion was seconded by Alderman Gallagher and carried unanimously. ORDINANCE 1792 - AN ORDINANCE PROVIDING FOR BORROWING MONEY AND ISSUING $330,000 GENERAL OBLIGATION BONDS, SERIES 1988 OF THE CITY OF LAKE FOREST, LAKE COUNTY, ILLINOIS, AND PROVIDING FOR THE LEVY AND COLLECTION OF A DIRECT ANNUAL TAX FOR THE PAYMENT OF THE PRINCIPAL AND INTEREST ON SAID BONDS: Steve Lutz, Assistant to the City Manager, introduced and reviewed an ordinance entitled, "An Ordinance Providing for Borrowing Money and Issuing $330,000 General Obligation Bonds, Series 1988 of The City of Lake Forest, Lake County, Illinois, and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on Said Bonds." A motion was made by Alderman Gallagher that the first reading of the ordinance be accepted and acknowledged, and that the ordinance be held on file by the City Clerk for second reading and action thereupon. The motion was seconded by Alderman Davies and carried unanimously. X. ORDINANCE 1785 - AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW FOR A 2-LOT PLANNED HISTORIC PRESERVATION DEVELOPMENT SUBDIVISION FOR PROPERTY LOCATED AT 787 E. ILLINOIS ROAD (ROWE - FINAL APPROVAL): A motion was made by Alderman Fassnacht that an ordinance entitled, "An Ordinance Granting a Special Use Permit to Allow for a 2-Lot Planned Historic Preservation Development Subdivision for Property Located at 787 E. Illinois Road", which was introduced and read at the meeting of � l3 99 Proceedings of the City Council Special Meeting -- Saturday, October 15, 1988 August 1, 1988, be passed. The motion was seconded by Alderman Johnson. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay': None. Alderman Galloway was absent. The ordinance was declared passed. Alderman Johnson moved to grant approval to the plat of subdivision. The motion was seconded by Alderman Davies and carried unanimously. XI. ORDINANCE 1775 - AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW FOR A SIX -LOT PLANNED HISTORIC PRESERVATION DEVELOPMENT SUBDIVISION FOR PROPERTY LOCATED WEST OF ESTATE LANE BETWEEN BOWLING GREEN DRIVE AND OLD MILL ROAD (JANKO - FINAL APPROVAL): Charles E. Crook Director of Planning and Development, reviewed an ordinance entitled, "An Ordinance Granting a Special Use Permit to Allow for a 6-Lot Planned Historic Preservation Development Subdivision for Property Located west of Estate Lane, Between Bowling Green Drive and Old Mill Road", which was introduced and read by title at the meeting of June 18, 1988. A motion was made by Alderman Johnson that the ordinance be passed, subject to the conditions of the Plan Commission the addition of a recommendation that the swale be constructed as part of the developer's plan and subject to the approval of the City Engineer. The motion was seconded by Alderman Fassnacht. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. The ordinance was declared passed. A motion was made by Alderman Johnson that the final approval be granted to the subdivision plat. The motion was seconded by Alderman Elting and carried unanimously. XII. RESOLUTION 1994 - WETLANDS PRESERVATION POLICY STATEMENT: A motion was made by Alderman Gallagher that a resolution regarding the City's Wetlands Policy, be adopted. The motion was seconded by Alderman Woloson and carried unanimously. XIII. REPORT AND RECOMMENDATION FROM THE ZONING BOARD OF APPEALS REGARDING A FRONT YARD SETBACK VARIATION FOR PROPERTY LOCATED AT 1566 N. WAUKEGAN ROAD (WRIGHT): Charles E. Crook, Director of Planning and Development, reviewed the report and recommendation of the Zoning Board of Appeals and the proposed ordinance. A motion was made by Alderman Morrison to accept the report and recommendation from the Zoning Board of Appeals. The motion was seconded by Alderman Johnson and carried unanimously. ORDINANCE 1793 - AN ORDINANCE GRANTING A VARIATION FROM THE LAKE FOREST ZONING CODE (WRIGHT): A motion was made by Alderman Morrison that the first reading of an ordinance entitled, "An Ordinance Granting a Variation from Section 46-35-(D) of the Lake Forest Zoning Code With Respect to Property Located at 1566 North Waukegan Road", be accepted and acknowledged and that the ordinance be held on file by the City Clerk for second reading and action thereupon. REPORT AND RECOMMENDATION FROM THE ZONING BOARD OF APPEALS REGARDING AN INTERIOR SIDE YARD SETBACK VARIATION FOR PROPERTY LOCATED AT 1350 N. LAKE ROAD (MILES): Charles E. Crook, Director of Planning and Development, reviewed the report and recommendation of the Zoning Board of Appeals and the proposed ordinance. A motion was made by Alderman Johnson that the report and recommendation from the Zoning Board of Appeals be accepted. The motion was seconded by Alderman Davies and carried unanimously. ORDINANCE 1794 - AN ORDINANCE GRANTING A VARIATION FROM THE LAKE FOREST ZONING CODE (MILES): A motion was made by Alderman Johnson that the first reading of an ordinance entitled, "An Ordinance Granting a Variation From Section 46-35-(D) of the Lake Forest Zoning Code With Respect to Property Located at 1350 Lake Road", be accepted and acknowledged and that the ordinance be held on file by the City Clerk for second reading and action thereupon. The motion was seconded by Alderman Davies and carried unanimously. XV. REPORT AND RECOMMENDATION FROM THE ZONING BOARD OF APPEALS REGARDING AN INTERIOR SIDE YARD SETBACK VARIATION FOR PROPERTY LOCATED AT 1161 S. VALLEY ROAD (DUYCKINCK): Charles E. Crook, Director of Planning and Development, reviewed the report and recommendation from the Zoning Board of Appeals and the proposed ordinance. Alderman Elting moved that the report and recommendation from the Zoning Board of Appeals be accepted. The motion was seconded by Alderman Gallagher and carried unanimously. ORDINANCE 1795 - AN ORDINANCE GRANTING A VARIATION FROM THE LAKE FOREST ZONING CODE (DUYCKINCK): A motion was made by Alderman Elting that the first reading of an ordinance entitled, "An Ordinance Granting a Variation From Section 46-37 of the Lake Forest Zoning Code With Respect to Property Located at 1161 S. Valley Road", be accepted and acknowledged and that the ordinance be held on file by the City Clerk for second reading and action thereupon. The motion was seconded by Alderman Gallagher and carried unanimously. XVI. REPORT AND RECOMMENDATION FROM THE ZONING BOARD OF APPEALS REGARDING A VARIATION FROM THE 50-FOOT SETBACK REQUIREMENTS AS SET FORTH IN THE LOT -IN-DEPTH PROVISIONS OF THE ZONING CODE FOR PROPERTY LOCATED AT 906 GREEN BAY ROAD (KRAUSS): Charles E. Crook, Director of Planning and Development, reviewed the report and recommendation from the Zoning Board of Appeals and the proposed ordinance. Alderman Morrison made a motion to accept the report and recommendation from the Zoning Board of Appeals. The motion was seconded by Alderman Fassnacht and carried unanimously. ORDINANCE 1796 - AN ORDINANCE GRANTING A VARIATION FROM THE LAKE FOREST ZONING CODE (KRAUSS): A motion was made by Alderman Morrison that the first reading of an ordinance entitled, "An Ordinance Granting a Variation From Sections 46-7-(A) and 46-35 of the Lake Forest Zoning Code With Respect to Property Located at 906 Green Bay Road", be accepted and acknowledged and that the ordinance be held on file by the City Clerk for second reading and action thereupon. ORDINANCE 1797 - AN ORDINANCE AMENDING CHAPTER 43, VEHICLES FOR HIRE, OF THE LAKE FOREST CITY CODE, 1971, AS AMENDED: Rosemary Haack, Assistant to the City Manager, introduced and reviewed an ordinance entitled, "An Ordinance Amending Chapter 43, Vehicles for Hire, of the Lake Forest City Code, 1971, As Amended." A motion was made by Alderman Johnson that the first reading of the ordinance be accepted and acknowledged, and that the ordinance be held on file by the City Clerk for second reading and action thereupon. The motion was seconded by Alderman Fassnacht and carried unanimously. XVIII. BIDS FOR PAVING AT THE DEERPATH GOLF COURSE CLUBHOUSE: DeSha Brandt, Assistant to the City Manager, reviewed the following bids that were received for this project: Vendor Bid Pioneer Blacktop, Inc. $ 7,535.00 Volpe, Inc. $ 8,362.00 Alderman Woloson moved to award the contract to Pioneer Blacktop, Inc., based on their low bid of $7,535. The motion was seconded by Alderman Morrison. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. The award of contract was approved. XIX. BIDS FOR THE 1989 PAVEMENT CRACK/JOINT SEALING PROGRAM: DeSha Brandt, Assistant to the City Manager, reviewed the proposed program and the only bid received for this work. Vendor Bid SEC Construction, Inc. $1.40 per pound With a ceiling price of $25,000 for the program, Alderman Morrison moved to award the contract to SKC Construction, Inc. The motion was seconded by Alderman Gallagher. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. The award of contract was approved. XX. BIDS FOR THE CONSTRUCTION OF VEHICLE/EQUIPMENT GARAGES AT THE MUNICIPAL SERVICES CENTER: Alderman Johnson reviewed the bids received for this project. They were as follows: PJ Proceedings of the City Council Special Meeting -- Saturday, October 15, 1988 102 Vendor Pickus Construction and Equipment Company Ruskin Lack, Gen. Cont. Base Bid Alt. Bid $920,197 $140,415 $933,986 $ 86,870* *Contractor did not bid on 8 of the 18 alternate items. Total Bid $1,060,612 $1,080,766 Alderman Johnson moved to accept the low bid of Pickus Construction and Equipment Co. The motion was seconded by Alderman Gallagher. Upon a roll call vote, the following aldermen voted "yea": Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay": None. Alderman Galloway was absent. The award of contract was approved. XXI. BIDS FOR THE CONSTRUCTION OF A MAINTENANCE GARAGE/PICNIC PAVILION AT THE BEACH: Steve Lutz, Assistant to the City Manager, reviewed the only bid received for this project. Company Base Bid Alt. Bid * Total Bid Ruskin Lack Gen. Cont. $313.944 $7,240 $321,184 *Cost of constructing concrete walks around the area. With a ceiling of $400,000 for the project, Alderman Johnson made a motion to award the contract to Ruskin Lack General Contractors, Inc. The motion was seconded by Alderman Davies. Upon a roll call vote, the following aldermen voted "yea': Johnson, Davies, Fassnacht, Morrison, Woloson, Elting and Gallagher. The following aldermen voted "nay': None. Alderman Galloway was absent. The award of contract was approved. XXII. OPPORTUNITY FOR THE PUBLIC TO ADDRESS THE CITY COUNCIL: Al Glover of 254 Park Avenue, questioned whether there were any plans to rehabilitate the West Park Field House. John Fischbach, City Manager, responded to the question. Mr. Glover also verified again that his letter would be made a part of these proceedings. Alderman Elting then asked if he might respond to one of the charges in the letter. He disputed the accusation that the Public Hearing on the Conway Farms annexation had been orchestrated by the City Manager, rather than a spontaneous show of support by the citizens. Alderman Gallagher spoke in defense of the City Manager, the Council and City staff who had worked so long and so hard on a project they genuinely believed to be beneficial to the City. Alderman Johnson stated that the Council members were also residents of the community and would never support a project they felt was detrimental to the City or its people. Alderman Woloson commented on the reported coercive manner in which the petition opposing the annexation was circulated. Alderman Morrison disputed the charge that the annexation proceedings had been carried on in secrecy. He stated that his project has been dealt with periodically for roughly twenty years and had been targeted for annexation in the Comprehensive Plan. CONVENE INTO EXECUTIVE SESSION: A motion was made by Alderman Johnson to adjourn into Executive Session to discuss pending litigation, land acquisition and personnel, as authorized by Section 42, Chapter 101 of the Illinois Revised Statutes. The motion was seconded by Alderman Morrison and carried unanimously. XXIV. RECONVENE: The Honorable Marshall C. Strenger, Mayor, was present and called the meeting to order. There was no one present in the audience. It was decided that due to the lateness of the hour, there would be no discussion in Executive Session. XXV.
